More serious is another aspect of the measure: It is an attempt to end-run the U.S. constitution.  The ballot measure tries to place authority over the electors in the hands of the voters instead of the legislature. Article II, Section 1, Clause 2  gives sole authority over the electors to the state legislatures:  "Each state shall appoint, in such manner as the Legislature thereof may direct, a number of electors, equal to the whole number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or person holding an office of trust or profit under the United States, shall be appointed an elector."   This was no accident. The constitutional convention gave extended attention to the issue of how to elect a president, and the delegates had state legislatures in mind through much of it, even considering election of the president by the legislatures at one point.  In the end they gave the legislatures authority over the electors, keeping it out of the hands of Congress, state governors, or the voters. Thomas Hiltachk, the sponsor of the California proposition, could go to the California Legislature, seek the change, and make his case.  It's fair to ask why he chooses the initiative process over that prescribed by the founders.   Incidentally, the winner-take-all feature of state electoral votes is not required by the constitution. The constitutional convention delegates never dreamed it would happen.  It was enacted by the state legislatures to benefit the political parties.   Oh, one more thing-- the option of placing an initiative on a primary ballot is not available in Nevada.
