For some, exercising the right to pick our leaders doesn't seem to mean much while for others it would take Hannibal's elephants to keep them away from the polls.  No one has ever answered the dilemma properly as far as is known.  Between early voting and today's open booths some 1.2 million Nevadans are eligible to cast ballots in the 2006 Primary Election.  How many actually will is open to conjecture, but at least this year you have options, you have opportunities to decide for yourself rather than having the decision made by some money-bags sitting in a high corner office somewhere. Top News Story:

State Gamers Win $12.1 Billion During Fiscal Year 2005-2006

June 2006 Brought Less Than Anticipated: Gaming Control Board

The figures for casino win for June 2006 also completed the financial picture for the fiscal year 2005-06, and the amount of money in the discussion was high indeed.  Casino win is that amount taken in by gaming only and before any expenses are considered.  In June 2006, Nevada's casinos raked in $921,077,156, down 3.47 percent from June 2005.  For the fiscal year that ended June 30, the gaming companies hauled in $12,193,784,439, up 10.8 percent from the previous fiscal year.  The largest part of the yearly take came from Clark County casinos, $10.2 billion.  The Clark County win was 11.7 percent higher than fiscal year 2004-05.

An example of one of the expenses casinos face is state taxes on the win.  In June, the gamers' win of $921 million brought $55.1 million to the state's coffers.  There have been many in the state that believe Nevada's gaming tax is too low.  It is the lowest of all states with regulated and legal gaming.  Some have stated regularly that Nevada's education system is as poor as it is because the state's primary industry doesn't pay its fair share.  There hasn't been any outstanding call for higher gaming taxes from any of the candidates running for legislative or state posts during this Primary Election cycle.  See full story

Malone Corruption Trial To Begin September 18

Denied: Defense Motion For Change of Venue 

Former police officer and Clark County Commissioner Lance Malone's corruption trial is set to get underway on September 18 in federal district court.  Malone's defense attorney wants to have the trial moved saying there has been too much news coverage of the events.  Federal prosecutors say it's just a ruse to delay the trial.  Federal District Judge Larry Hicks agrees with prosecutors and has issued a ruling against moving or delaying the trial.  Hicks said, "Malone ... has failed to demonstrate that this news coverage is likely to result in prejudice."

Malone, accused of being the bagman for Michael Galardi, and found guilty of political corruption and bribery in San Diego, California federal court in 2005, is looking at considerable prison time if he is also found guilty in Clark County federal court.  See full story

City Of Las Vegas Charged As Profilers Or Bigots In Bar Action

Attempt To Close Squiggy's Bar Backfires On City Attorney And Council

Following hundreds of police calls to Squiggy's Bar in Las Vegas, the City Council heard arguments to close the saloon.  Owners Danny Piper and Joseph Bunch were told to either sell the operation, give up their license to sell liquor and operate gaming devices or have those licenses revoked and the bar closed.  The council was working with the city attorney to come to an agreement under which the operation could remain open for six-months giving the owners an opportunity to sell an operating business, but they came a cropper.

Squiggy's has been known as a place where patrons are physically beaten regularly, that even people near the joint are accosted, and a general unlawfulness persists.  In less than a year and a half police have been called more than 250 times, shootings and death have been regular features of the place, and a beating seems to be among the lesser problems.  There was no doubt at the council table that something had to take place. First Step Toward Changing Coroner's Inquest Law Taken

Numerous Police Shootings Brought About Calls For Upgrading The Code

Las Vegas police have shot at least 20 people so far this year and every incident has been justified by way of a coroner's inquest.  The American Civil Liberties Union (ACLU) and the National Association for the Advancement of Colored People (NAACP) have called for an investigation of the way the inquests are handled.  Following a meeting with the County Commission it was determined that a group must be formed to investigate whether changes in the law are necessary.  In the meantime a federal suit has been filed by the family of one man that was shot in back while handcuffed and attempting to escape.  The inquest verdict was justifiable shooting. 

A coroner's inquest in Clark County is called nonadversarial in that only the district attorney can call witnesses or come before the jury.  No other attorneys or witnesses are allowed to testify.  Those calling for changes say this loads the investigation on the side of the police and has led to less than fair decisions.  The hearings are open to the public, but only one side is heard by the jury.  Those seeking changes believe that the family of the person killed by the police should be heard by way of advocates (attorneys).  See full story

Battle Looms Over White Pine's Proposed Power Plants

Sierra Pacific Resources Has Plans, As Does New Jersey's LS Power Group 

A controversy is building over the building of coal fired power plants in White Pine County in eastern Nevada, and the final answer will probably come from Nevada's Public Utilities Commission (PUC).  New Jersey power company LS Power Group has plans for large coal fired operations in the county and is claiming that Sierra Pacific Resources, parent company to Nevada Power and Sierra Pacific Power Company (SPPCo) has stolen their plans.  The plants from both companies are scheduled to be part of a giant $3.7 billion operation called Ely Energy Center.

The competing plans are to come before PUC hearing officers, but LS Power is claiming they may not be heard during the Sierra Pacific Resources hearings, that they (LS Power) may be barred from taking part in the hearings.  That argument will also be heard by the PUC.  See full story

Federal Land Sales To Benefit White Pine, Mineral, Washoe

Southern Nevada Public Lands Management Act Responsible

Governor Kenny Guinn says he has high hopes for the quick passage of a U.S. Senate bill sponsored by Nevada Senators Harry Reid (D) and John Ensign (R) designed to provide an economic boost for financially strapped White Pine County in eastern Nevada.  Guinn said the proposed changes to the Southern Nevada Public Lands Management Act (SNPLMA) will set aside and or create wilderness and recreation areas in the vicinity.

According to the governor the changes in the law will allow up to 45,000 acres of Bureau of Land Management (BLM) lands to be sold to private interests with the revenue generated distributed to the State Permanent School Fund, White Pine County, and various conservation efforts in White Pine County.  The governor said, "I applaud the efforts of our two senators in trying to bring additional revenue streams to White Pine County." Fires, Lake Clarity, Protection Discussed At Tahoe Gathering

Nevada, California, Federal Officials Meet For Ninth Annual Tour

Called the Annual Lake Tahoe Summit, a group of state, and federal officials met at Sand Harbor on the east shore of America's Jewel of the Sierra on august 10 to discuss issues that impact on the lake's pristine qualities.  Governor Kenny Guinn led the Nevada delegation that included Senators Harry Reid and John Ensign.  The two senators are responsible for legislation at the national level that has led to considerable protection for the lake.

Among the featured speakers were Dirk Kempthorne, Secretary of the Interior and Stephen Johnson, Administrator of the Environmental Protection Agency.  Governor Guinn said, "Lake Tahoe is one of the most picturesque places on earth ... ."  He commented that "These summits serve as a vital step in combining our efforts on the state and federal level to protect this natural beauty for generations to come."  The first summit was held in 1997. Repercussions Continue Following DOE Yucca Mountain Proposals

"Arbitrary And Capricious" Are Terms Being Used In Washington

Senate hearings on the Yucca Mountain nuclear waste repository continue with the Department of Energy (DOE) saying that with their timetable for opening just 11 years away, it is imperative that Congress gives them everything they ask for or it will be Congress's fault that the timeline isn't met.  Unlimited money, DOE Yucca boss Ward Sproat says is part of the key along with relieving DOE of most safety requirement, and overlooking some of the fraudulent practices allegedly promulgated by some USGS scientists in order to make the project look good.  The best defense is often an excellent offense, and putting the blame for failure on another works as well. 

Some of the problems that Sproat feels will keep the DOE from its timetable include basic safety procedures during transportation and changing the way the federal government works with states.  DOE feels they should be able to simply take water from Nevada watersheds without following state procedures for acquiring water rights.  In a statement to the Committee on Energy and Natural Resources, Bob Loux, Executive Director of the Nevada Agency for Nuclear Projects said, "You have a bill before you that attempts, like a cowcatcher on a locomotive, to anticipate and sweep aside every potential health and safety obstacle that could upset the relentless drive to begin receiving highly radioactive waste and spent nuclear fuel at Yucca Mountain."  Loux continued, "Removal of potential health and safety obstacles to expedite licensing and operation of a Yucca Mountain repository does nothing to advance the primary safety finding of the Nuclear Waste Policy Act." USA Capital's Financial Failure Not Considered Public Document?

 Cost To Investors High, Cost To Nevada's Financial Reputation Higher 

Following the failure of USA Capital lending institution, the Las Vegas Review-Journal newspaper attempted to acquire a copy of the audits used by the state lending division.  In a letter to the newspaper, Scott Bice, commissioner of the Mortgage Lending Division said he will not make the audits available to the public until his investigation is complete.  Bice cited state law that permits him this secrecy.

When a company that operates under the control and conditions of a state agency fails, and audits have been done, those audits should be public documents.  Many people have lost money in the multi-million dollar failure.  According to a quote published by the Review-Journal, editor Thomas Mitchell said, "Secrecy is also a way to conceal a lack of due diligence by public agencies." Activity At The PUC Includes Budget, Conservation, Privacy

At least one state agency doesn't have its fingers in the current horde of money that has come from a combination of a large across the board tax increase and splendid economic conditions in the Silver State.  With a budget surplus looming, the governor has all but told agencies to expand their outlook for 2007-09, but the Public Utilities Commission (PUC) released information that their budget would not be increased for the next biennium, but would be cut slightly.

The PUC voted to approve a flat line budget as recommended by Crystal Jackson, Commission Secretary.  Jackson said, The PUC has continued its commitment to cut out unnecessary spending and it is reflected in the proposed 2007-09 budget, which is less than the last biennial budget." See full story

It’s rare that we at TNO delve into national or international situations -- after all there is more than enough going on in Nevada to keep us going and involved -- but every once in a while we feel it is necessary to put our two cents on the table.  The current state of the U.S. military is the bone in my throat right now.  I'm already in my Social Security years, and that of course means I was around during the Vietnam era.  Boy was I, but this isn't a memoir on Vietnam any more than it is a critique of Iraq.  It is neither but it is a reflection that those who served in the military prior to Iraq will fully understand.  Wearing that uniform, whether army, navy, marine, air force, or coast guard carried responsibilities that weighed on one's moral fiber daily.  Those in command today have relegated military morality to the garbage pit of history and someday it will come back and bite all of us in the ass.  See full Opinion

The Irascible One

One somewhat nice thing --- The Primary is over and many obnoxious people will now go away for a couple of years.  They will be back, damn it.  There are now much fewer recorded phone calls we will have to put up with.  Call me personally, that's fine.  Don't give me a chance to say hello, and I'll say goodbye.  This form of campaigning is the most obtrusive the candidates have found to date.  Mailers can be used to start fires (or wrap fish), TV ads can be muted, but that damn phone call when dinner is on the table, when it's time to turn the burgers on the grill, when I just got out of the shower is the most obscene by far.

Kettles and pots and things --- Strange how some people react when they accuse people of doing what they are most often accused of themselves.  Point in question: A radio station offered some doughnuts and other goodies to some homeless dudes and dudettes in a Las Vegas park the other day and were promptly arrested under the new ordinance prohibiting such activity.  Las Vegas's Happiest Mayor in the World accused them of conducting a "publicity stunt."  Well, duh.  Of course, hiz honor has never done anything for the publicity value of doing it.  Ever.  Even with fourth graders and Bombay Gin.  Ever.  See full blog.

Who's On First? Nevada's First Newspaper

The masthead on Lucius Beebe and Charles Clegg's inaugural version of the Territorial Enterprise on May 2, 1952 claimed the famous publication was "Nevada's First Newspaper." When they resurrected the newspaper, the two colorful bon vivants and raconteurs probably believed it to be true. After all, Myron Angel's History of Nevada (1881) claimed the newspaper was "the pioneer paper of the Territory." Everyone seemingly wants a first and so did Beebe and Clegg in their efforts to hype Virginia City and the Comstock in the 1950s. However it's not true. Let me tell you why.  See full column.
